General Information 

This document outlines the terms and conditions under which buyers access the website www.langfordmethod.com. We encourage you to read these terms carefully to understand our company policies. By using this website, you agree to these terms and conditions, which apply to all contracts made with Langford SpA.

 

All use of this website and the contracts established are subject to the laws of the Republic of Chile, particularly Law 19.496 on Consumer Rights Protection. Langford SpA is committed to upholding the rights and protections granted to consumers by this law and adheres to the Code of Good Practices for E-Commerce from the Santiago Chamber of Commerce.

 

Communications 

For inquiries or complaints regarding the use of this site or contracts established herein, please contact our legal representative, Mr. Mark Pacheco Langford, at contact@langfordmethod.com or by phone at +56 9 2756 0996. Our business office is located at Av. Alonso de Cordova 5870, office 724, Las Condes, Santiago, Chile.

 

Any advertising or promotional emails we send will include the following information:

1. A clear identification of the message as advertising or promotional content in the subject line.

2. The consumer's right to request cessation of such communications and Langford SpA's obligation to comply.

3. A straightforward procedure for consumers to request suspension of these communications, including a designated email address.

4. The advertiser's identity with their trade name.

 

For teaser advertising, we will uphold the same commitments if we identify the responsible agency. We will remove from our mailing list anyone who expressly requests to stop receiving advertising or promotional emails.

 

Regarding Impersonating Accounts on Social Media 

The only official accounts of Langford SpA on social media are as follows:

Any other accounts displaying our logo, name, or variations are not affiliated with us. Langford SpA disclaims any responsibility for scams conducted through impersonating accounts.

Freedom of Navigation and Acceptance of Terms and Conditions 

Simply visiting this site does not impose any obligations on the user unless they explicitly indicate their intention to engage with the company to purchase goods or services through affirmative actions, as outlined in these terms and conditions. 

To accept these Terms and Conditions, the user must click on the option provided on the Langford SpA website that includes the phrase "I have read and accepted" or a similar statement that indicates unequivocal consent.

Registration 

While registration on the site and the use of a password are not mandatory for contracting, they do facilitate personalized, confidential, and secure access. If you decide to register, you will receive a secret password that you can manage and modify as needed. Both the user and the administrator share responsibility for maintaining the confidentiality of the password.

Payment Methods 

Products and services on this site can be paid for only with credit cards such as Visa, Mastercard, Dinners Club International, or American Express issued in Chile or abroad, provided they maintain active contact with Langford SpA. Debit cards issued by national banks in Chile, such as Redcompra, are also accepted. Payments made with debit cards are processed via Pago Fácil. Please note that these payment methods are provided by third-party companies independent of Langford SpA. 

 

Users understand that these payment methods or portals belong to third-party service providers that are independent and not affiliated with Langford SpA. Consequently, the continuity of these services over time, as well as the proper functioning of their online payment tools and buttons, is the sole responsibility of these service providers, not Langford SpA.

 

RIGHTS AND GUARANTEES

Exchanges and Returns 

If a purchased product does not meet your satisfaction, you can exchange or return it within 30 days of receipt at the original delivery location. You will be responsible for covering return shipping costs and the reshipping cost for exchanges, based on our rates. To be eligible for an exchange or return, the product must be unused and in its original packaging with all accessories. For certain product categories, items must remain sealed and unopened.

To initiate an exchange or return, please provide the receipt, delivery guide, exchange ticket, or another proof of purchase. If you request a refund, we will process the reimbursement using the payment method you used, within up to 20 business days of accepting the return. You will receive confirmation of the refund via email.

You have 24 hours to report any issues with your order (such as broken, damaged, or missing items, or problems due to weather conditions). After this period, Langford SpA will not be liable for the situation. Please note that the right of withdrawal established by Law No. 19.496 for non-in-person purchases does not apply to the various purchasing channels of Langford SpA.

 Legal Guarantees 

Under Law No. 19.496, consumers have the right to choose between three options: a refund, an exchange, or a repair of the product within three months from the purchase date, if the product has a defect or fault. 

With the recent amendment to the Consumer Law effective March 24, 2022, the legal warranty period for products has been extended from three to six months. During this time, consumers can request either a replacement for the defective product or a refund of the amount paid. 

What is a Digital Product? 

A digital product refers to any item that exists solely in virtual form, delivered via messages, email, file transfers, or other digital means. Digital products include: 

  • Activation licenses for various programs.
  • Programs, games, or operating systems available for online download.
  • E-books, PDFs, and other similar documents. 

For this website, the term "Programs" is used interchangeably with "License," indicating permission to access the online learning programs available on our platform.

Defects in a program are considered as issues related to: 

  • Functionality of the program.
  • Videos.
  • Correction of exercises and/or evaluations.
  • Delivery of results. 

It is essential to note that the legal guarantee does not apply if the request is solely due to the consumer not liking the product. 

Both businesses and consumers must differentiate between the right to a legal guarantee and the right of withdrawal. The right of withdrawal allows consumers to change their minds about a purchase made online or through other electronic channels, provided the product has not been used and is returned in its original packaging, along with user manuals, warranty certificates, and any other accompanying materials. If these conditions are met, the corresponding amount will be refunded. 

Right of Withdrawal 

Langford SpA does not adhere to the right of withdrawal. This right allows consumers to reconsider purchases made online or through other electronic means; however, it does not apply to our company.

Delivery of Digital Products 

Digital products are automatically sent to the email address you provided during the purchase process. When you purchase any product from Langford SpA, you should receive two emails: a confirmation email and another with instructions for accessing the online platform. If you do not receive these emails within the expected delivery timeframe, please check your SPAM folder. If the email address is incorrect and you haven't received the communication, contact us at contacto@metodolangford.cl.

Liability 

Langford SpA shall not be liable for: 

  • Misuse of materials displayed on the site by users or visitors and for violations of industrial and intellectual property rights.
  • Damages or potential losses incurred by buyers and/or users due to search tool functionality or errors caused by the site's technical elements.
  • Content on pages accessed by users with or without Langford SpA’s authorization.
  • Access by minors or individuals with disabilities to content linked to the contractual relationship from the site, as per applicable laws.
  • Loss, misuse, or unauthorized use of your validation code, whether by the user and/or buyer or third parties, after the purchase as specified in the terms and conditions.
  • Information regarding Langford SpA or its services found on websites other than www.langfordmethod.com.
  • If a product's price is published significantly lower than its cost due to an error (e.g., a sale price of $0, $1, $10, $100, etc.), the company reserves the right to cancel the transaction. In these cases, Langford SpA will work to restore the site and the computer system promptly, without assuming any liability. Langford SpA does not guarantee the availability or continuous operation of the site, nor that users will have access to promotions and offers at any time. 

Langford SpA is not responsible for viruses or other harmful elements present in electronic documents stored in users' computer systems. The company will not assume liability for any damages incurred by the client due to improper use of available technologies, regardless of their usage. Moreover, Langford SpA will not be liable for damage to the site due to misuse or malicious actions by users and/or buyers. Nevertheless, if a user or buyer makes a duplicate payment due to an error, Langford SpA will refund the excess payment within 3 business days of receiving a written claim from the user or buyer, including original receipts for the additional payment made.

During the processes of login, registration, and communication with payment service companies, Langford SpA utilizes digital security certificates (SSL) to encrypt communications. The company neither manipulates nor stores customers' financial data.

In all cases, Langford SpA's liability—whether contractual, extracontractual, or legal—toward users, buyers, or visitors to the site shall not exceed the amount actually paid by the buyer for the product or service, without prejudice to the rulings of the Courts of Justice.

Data Security and Secret Key 

Users are responsible for the information registered on the site. Langford SpA will implement the necessary measures to ensure the security of data and the secret key by using encryption systems, security certificates, and other appropriate measures. If any changes are detected in the registered information or if irregularities arise in transactions related to identification or payment methods, our representatives may contact you by phone or email to verify your information and prevent potential fraud. If we are unable to establish contact within 72 hours, for security reasons, the purchase order made on our site will not be confirmed. We will inform you via phone or email that your order has been canceled due to our inability to verify your identity or payment method. Additionally, records of our attempts to contact you and confirm the transaction will be available at our offices for 30 days for you to verify the purchase order. However, users and/or buyers are solely responsible for the loss, misuse, or unauthorized use of the validation code, whether by themselves or by third parties, after completing the purchase pursuant to these Terms and Conditions.

Personal Data 

Users and/or buyers guarantee that the information provided for the contract is truthful, complete, accurate, and up to date. In accordance with Law No. 19.628, the personal data provided on the website will be included in a database managed by Langford SpA and will be used solely for the purposes for which it was supplied, including communication with customers, validation of purchase data, management of shipments, and responding to inquiries. This data will not be shared with other companies without the express consent of the data owner, nor will it be transferred internationally. It is important to note that Langford SpA never requests personal or financial data via email.

The company assumes that the data has been provided by its owner or an authorized person and that it is accurate. By accepting these Terms and Conditions, users and/or buyers acknowledge that the personal data they provide through online forms on the Langford SpA website may be used for future offers that differ from those available on the site. However, Langford SpA guarantees users the full exercise of their rights to access, modify, cancel, and block their personal data as established under Law No. 19.628. Therefore, buyers can request the exercise of these rights, and Langford SpA must respond and fulfill such requests within a maximum of two business days.

Electronic Documents 

The user, in their capacity as a manual recipient of electronic documents, agrees to the following in accordance with Exempt Resolution No. 11 issued on February 14, 2003, by the Internal Revenue Service (which established the procedures for authorized taxpayers to issue electronic documents and send them to manual recipients): 

By accepting these terms and conditions, the user authorizes Langford SpA, RUT 76.053.871-K, to deliver the corresponding tax document for this transaction solely through electronic means. The user also consents to receive notification of the publication of the tax document via email.

In accordance with the regulations, if the user needs to support accounting information, they assume the following obligations regarding these tax documents: 

  • Print the electronically received documents for each tax period immediately after receiving them from the issuer.
  • Print the document in the size and format it was generated.
  • Use original white paper with a minimum size of 21.5 cm x 14 cm (1/2 letter) and a maximum size of 21.5 cm x 33 cm (legal).
  • Print in a quality that ensures readability for at least six years, as required by current legislation. This will typically require the use of laser or inkjet printing unless otherwise specified.
Scope of Site Conditions:

Langford SpA will not alter the conditions under which it has contracted with consumers through this website. The prices shown on this website will be available to users, even if they differ from those offered through other Langford SpA sales channels, such as physical stores, catalogs, TV, radio, or other media. It's important to note that these prices apply specifically to the delivery or shipping city. If a product is added to the shopping cart and the delivery or shipping address is subsequently changed to a different city, the total product price will be adjusted to reflect the shipping costs to the new location.

Any changes to the information posted on this site—including details about products, services, prices, availability, terms, promotions, and offers—will be made prior to the generation of a purchase order and will only apply to future transactions. These changes will not affect consumers' rights from previous transactions.

Promotions available on this website may not be the same as those offered by Langford SpA through other sales channels. For promotions that include the free or discounted delivery of a product upon the purchase of another, the free or discounted item's delivery will occur at the same location as the purchased product, unless the buyer requests, when accepting the offer, that the products be sent to different addresses. In this scenario, the buyer must cover the shipping costs for both products. Participation in these promotions requires the joint purchase of all products included in the offer.

Intellectual Property 

All content on this site, including text, graphic materials, logos, button icons, source code, images, audio clips, digital downloads, and data compilations, is owned by Langford SpA or its content providers and is protected by Chilean and international intellectual property laws. The graphic elements, logos, page headers, advertising slogans, button icons, written content, and service names displayed on this site are trademarks, creations, or commercial images owned by Langford SpA in Chile and other countries. These trademarks, creations, and commercial images cannot be used in connection with any product or service that may cause confusion among consumers or that disparages or discredits Langford SpA. Any other trademarks not owned by Langford SpA that appear on this site are the property of their respective owners. 

All rights not expressly granted in these Terms and Conditions are reserved by Langford SpA, its assignees, suppliers, publishers, rights holders, and other content providers. No product, image, or sound may be reproduced, duplicated, copied, sold, resold, visited, or exploited for any purpose, in whole or in part, without the prior written consent of Langford SpA. Framing or using any framing techniques to enclose trademarks, logos, or other registered or patented information (including images, text, page layout, or format) of Langford SpA is prohibited without prior written permission. Additionally, the use of meta tags or any other "hidden text" that utilizes the name or trademarks of Langford SpA without the company’s prior written authorization is also prohibited. Any misuse of this site or these trademarks, licenses, or patents is strictly prohibited, except as expressly permitted by law.

Applicable Law and Jurisdiction 

These Terms and Conditions are governed by the laws of the Republic of Chile. Any disputes or conflicts arising from the use of the Langford SpA website, its Terms and Conditions, or its Privacy Policies—including their validity, interpretation, scope, or compliance—will be subject to the applicable laws of the Republic of Chile.

Langford SpA reserves the right to modify this document as necessary. 

By making a purchase, you automatically agree to these terms. 

If any part of this document is found to be illegal or unenforceable in your country of residence, that provision will be rendered void, while the remaining content will remain in effect.
